Refund policy

1. Scope of Application

1.1 These General Terms and Conditions (the "AGB") govern, in the version valid at the time of the order, all orders and deliveries and the associated purchase contracts via the website www.suedtirol-products.com
1.2 The Buyer is the natural or legal person who places the order (the "Buyer"). By placing an order, the Buyer declares that they are fully legally capable and that the personal data provided by them are correct.
1.3 The Seller is Südtirol Products – Seis-Seiser Alm Bahn AG, Schlernstraße 39, 39040 Kastelruth (BZ), Italy, registered in the Commercial Register of Bolzano with number 01370600213 and identical VAT number.

2. Conclusion of Contract

2.1 The Buyer's order constitutes a binding offer to conclude a purchase contract for the ordered goods (the "Order").
2.2 A purchase contract is only concluded with the express acceptance of the order by Südtirol Products by sending a corresponding order confirmation via E-Mail (the "Order Confirmation") or implicitly by delivering the ordered goods.

3. Prices

3.1 The prices shown in the Online-Shop at the time of the order (the "Prices") are valid. Südtirol Products reserves the right to change prices without prior notice.
3.2 Unless expressly agreed otherwise in writing, the prices are understood to include statutory value-added tax, plus any shipping costs and, if applicable, packaging costs in the case of gift packages, special compilations, and the like.
3.3 Notwithstanding other and further applicable legal provisions, VAT-free intra-community deliveries require the disclosure of the Buyer's UID-Nummer when ordering, as well as delivery to an address not located in Italy.

4. Shipping Costs

4.1 For the shipping of goods, shipping costs will be charged according to our delivery conditions.

5. Delivery and Risk

5.1 Unless otherwise agreed in writing, delivery of the goods will take place after receipt of full payment to the delivery address specified by the Buyer (the "Delivery").
5.2 Any information on delivery dates is always non-binding, unless Südtirol Products expressly agrees to a binding delivery date in writing.
5.3 At the discretion of Südtirol Products, delivery may also be made in several partial deliveries.
5.4 In the event of total or partial unavailability of the goods, there is no obligation to deliver. In this case, the Buyer will be informed by Südtirol Products. Payments already received will be refunded.
5.5 The risk passes to the Buyer as soon as the goods are handed over to the first carrier for transmission to the Buyer. This also applies in the case of partial deliveries.

6. Payment and Retention of Title

6.1 Payment of the full price (including shipping costs and, if applicable, packaging costs) is due upon receipt of the order. The place of performance for payment is the province of Bolzano (Italy).

6.3 If the goods are not paid for, or not fully paid for, for any reason after the order confirmation, and Südtirol Products nevertheless delivers the goods at its own discretion, the goods remain the property of Südtirol Products until full payment.
6.4 If a third party accesses the goods within the scope of enforcement or insolvency proceedings or other proceedings, or if the goods are subject to other third-party interventions, the Buyer must inform this third party of Südtirol Products' ownership rights, notify Südtirol Products thereof immediately, and provide all assistance to protect Südtirol Products' rights and interests.

7. Right of Withdrawal for Consumers

7.1 A buyer who qualifies as a consumer within the meaning of Italian Legislative Decree No. 206/2005 (the “Consumer Code”) has the right to withdraw from the contract within 14 (fourteen) days without giving any reason. The period begins on the day on which the buyer, or a third party named by the buyer, takes possession of the goods.
7.2 To exercise the right of withdrawal, a clear statement addressed to the following is sufficient: Südtirol Products – Seis-Seiser Alm Bahn AG, Schlernstraße 39, Seis am Schlern, 39040 Kastelruth (BZ), Italy. The buyer may use the EU withdrawal form or the withdrawal button in the online shop, but is not obliged to do so. To meet the deadline, it is sufficient to send the notification before the period expires.
7.3 The goods must be returned by post without undue delay and in any event no later than 14 days from the date of the withdrawal declaration to: Südtirol Products – Seis-Seiser Alm Bahn AG, Schlernstraße 39, Seis am Schlern, 39040 Kastelruth (BZ), Italy. The direct cost of returning the goods is borne by the buyer. No restocking fee is charged.
7.4 Südtirol Products will refund the purchase price including standard outbound shipping costs within 14 days of receiving the returned goods. The refund will be issued using the same means of payment used for the order, at no cost to the buyer.
7.5 The buyer may inspect the goods as they would in a shop. The buyer is only liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
7.6 For reasons of health protection and hygiene, the right of withdrawal is excluded for food, beverages and cosmetics whose seal or original packaging has been opened after delivery, as well as for goods liable to deteriorate rapidly or whose best-before date would be exceeded.

8. Warranty & Liability

8.1 The product images do not always correspond to the appearance of the delivered goods.
8.2 Südtirol Products' liability is limited to intent and gross negligence. Südtirol Products is in no case responsible for non-performance or defective performance if it was caused by force majeure.
8.3 Obvious transport damage must be claimed by the Buyer directly from the carrier.

9. Data Protection

9.1. Südtirol Products' data protection notice in accordance with Art. 13 Italian Legislative Decree No. 196/2003 is located in the Online-Shop itself, and the Buyer declares to have taken note of it.

10. Choice of Law and Jurisdiction

10.1 These AGBs and all legal relationships between the parties are subject to the law of the Italian Republic, excluding international private law.
10.2 If the Buyer is not a consumer within the meaning of consumer protection law, the province of Bolzano (Italy) is the exclusive place of jurisdiction for all disputes arising from or in connection with contracts between Südtirol Products and the Buyer.

11. Final Provisions

11.1 Should individual provisions of these AGBs be or become wholly or partially invalid, the remaining provisions shall remain unaffected.
11.2 The Buyer may not assign claims against Südtirol Products.
11.3 Ancillary agreements, amendments and supplements to these AGBs require written form.
11.4 The German version of these AGBs is authoritative.
